Terms of Service

These terms cover your use of FollowUp Agent (the "Service"), offered by AgentivX Solutions, LLC, a Maryland limited liability company at 2847 Aiden Way, Upper Marlboro, MD 20774 ("AgentivX," "we," "us"). By using the Service or buying a plan, you agree to them. If you use it for a company, you confirm you can agree on that company's behalf.

1. What the Service does

FollowUp Agent reads an outreach export you provide (for example, a LinkedIn Recruiter project CSV), flags contacts who haven't replied within a threshold you choose, ranks them, and lets you export the result. On the Pro plan it can also look up work email and phone numbers through Apollo using your own Apollo account. The Service is not affiliated with, endorsed by, or sponsored by LinkedIn or Apollo.

2. Plans and billing

• Starter is free and limited to 25 contacts per report.
• Pro is $49 per month, billed in advance through Stripe, and renews automatically each month until you cancel. You can cancel any time from the dashboard's Manage billing link. Cancelling stops future charges; Pro stays on until the end of the period you already paid for.
• Done-For-You is a one-time $499 fee for us to install the automation in accounts you own. The scope is the install described on our pricing page. Extra work, such as add-ons or custom changes, is quoted separately before we start.

Prices may change. We'll email Pro subscribers at least 30 days before a price change takes effect. Taxes are added where required.

3. Refunds

If Pro isn't working for you, email info@agentivx.ai within 14 days of your first charge for a full refund of that charge. Later monthly charges aren't refunded, but you can cancel any time. For Done-For-You, you can get a full refund if you cancel before your kickoff call. After work begins, refunds are limited to work not yet performed.

4. Your license key

Pro is unlocked with a license key tied to your subscription. It's for you, the subscriber. Don't share it, publish it, or use it to give access to people who haven't paid. We may disable a key that's being shared.

5. Your data and your responsibilities

Your CSV is processed in your browser and isn't uploaded to us. See our Privacy Policy for the details, including what passes through our server during Pro enrichment. You're responsible for having the right to use the contact data you load, and for following the laws and platform rules that apply to how you contact people, including LinkedIn's user agreement, Apollo's terms, anti-spam laws such as CAN-SPAM, and telemarketing rules such as the TCPA. FollowUp Agent doesn't send messages or place calls to your contacts for you.

6. Acceptable use

Don't use the Service to break the law, to harass anyone, to send unsolicited bulk messages, to probe or overload our systems, or to resell the Service without our written permission.

7. Ownership

You own your data. We own the Service, its design, and its code. For Done-For-You installs, you own the workflows we build in your accounts once your payment clears.

8. Disclaimers

The Service is provided "as is." Enrichment results come from Apollo and may be incomplete or out of date. We don't promise any particular hiring, placement, or revenue result, or that the Service will be uninterrupted or error free.

9. Limit of liability

To the extent the law allows, AgentivX isn't liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim related to the Service is limited to what you paid us in the 12 months before the claim.

10. Ending your use

You can stop using the Service at any time. We can suspend or end access if you breach these terms. Sections 5 through 11 survive.

11. Governing law

These terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Maryland.

12. Changes and contact

We may update these terms. If a change is material, we'll post it here and email Pro subscribers before it takes effect. Questions: info@agentivx.ai.
